New ‘List 2’ Exclusions
Another group of exclusions has been released by the Office of the United States Trade Representative. These exclusions apply to 111 specific products accounted for on List 2. The listing of eligible product descriptions can be found in the Federal Register post here:
What does this mean for your business?
This group of exclusions applies to specific products under particular HTS numbers. They do not apply to all products under that HTS number. Take a close look at your documents to ensure your products match the listed description exactly.
If your products do match the description listed, you are eligible to claim the exclusion on imports of this product for one year of the date of the Federal Register Posting (post dated 10/2/2019).
Additionally, you are eligible to reclaim duties for prior US Customs entries where the additional tariff applied. This can be done all the way back to August 23rd of 2018 – the date the additional duties began.
